تأملی بر جنبه‌های قانونی ایمنی تأسیسات هسته‌ای در ایران

چکیده

اساساً قوانین و مقررات ایران در زمینه ایمنی تأسیسات هسته­ای متأثر از ظوابط و معیار­های  شناخته شده بین­المللی است. محتوای بیشتر این مقررات، همان محتوای اسناد و مصوبات آژانس بین‌المللی انرژی اتمی در زمینه ایمنی تأسیسات هسته­ای است. با وجود این، مواردی از تفاوت و اختلاف نیز  بین آن دو  وجود دارد. در عین حال، قوانین و مقررات جاری ایران در زمینه ایمنی تأسیسات هسته­ای، کامل و کافی نیست و خلأها و نارسایی­هایی در آن مشاهده می‌شود. مقاله حاضر با بررسی قوانین و  مقررات موجود ایران در زمینه ایمنی تأسیسات هسته­ای و مقایسه آن با ضوابط و مقررات بین‌المللی، سعی کرده است ضمن روشن ساختن وضعیت حقوقی فعلی کشور در خصوص ایمنی تأسیسات هسته­ای، میزان مطابقت و هم‌سویی آن با معیارهای بین‌المللی شناخته شده را مشخص کند

  Basically Iran laws and regulations on the safety of nuclear installations were inspired by the respected international rules and norms, while in some cases there exist differences, the contents of most of these regulations are those of IAEA documents relating to safety of nuclear installations. In the mean time, the current laws and regulations of Iran on nuclear safety installations are not comprehensive, complete and sufficient. By comparatively analysis of Iran nuclear safety laws and regulations with those of IAEA, this article tries to clarify, describe and analyze current legal order of Iran in relation to nuclear installations safety and their compatibility with the established international norms .
